Frank VIP Advantage Program Terms
Overview of Program
The Frank Motors Group ("Frank Motors") VIP Advantage Program (the "Program") is a loyalty program administered by Smart Tech Enterprises. Upon receipt from Frank Motors of the VIP Advantage Program Membership Card/Account ("the VIP Account"), Member agrees to be bound the Program rules, terms and conditions. Each VIP Account is associated with one vehicle, which shall be identified by the last eight digits of the Vehicle Identification Number (the "VIP Vehicle"). Member will receive incentive points for qualified purchases of products and services at the dealerships owned by Frank Motors (hereinafter referred to collectively as "Frank Motors"). These points are ONLY redeemable for discounts at Frank Motors. For every dollar you spend at Frank motors toward qualified purchases, Frank Motors will apply Reward Points to your VIP Account in the following amounts:
*10% in the form of Purchase Reward Points, which may be redeemed to discount future new or pre-owned vehicle purchases if you trade in your VIP Vehicle at the time of purchase, not to exceed $500.
*5% in the form of Service Reward Points, which may be redeemed to discount future service on the VIP Vehicle.
*5% in the form of Tire Reward Points, which may be redeemed to discount tire purchases up to 10 points per tire on the VIP vehicle.
In addition to accruing Reward Points, Member will receive:
Mileage-based special offers, a one-time special offer, and seasonal special offers.
In addition to base member benefits, Gold Members will receive:
5% discount on Customer Pay labor (discount may not be combined with any other discount or special offer).
Reward Points have no cash value and cannot be redeemed for cash. Accrued Reward Points do not constitute property of a Member and have no value outside the Program.
Any items purchased through this Program cannot be returned for cash. The value of all returned items will be applied to the Member's VIP Account, reducing the Reward Points balances.
Reward Points continue to accrue only if Member makes at least one qualified purchase within any 12-month period. Failure to make a qualified transaction within any 12-month period will cause membership to expire. In the event of membership expiration, accumulated points must be used within two years of membership expiration or points will be forfeited.
Service Reward Points redemption may not be combined with any other discount offers. Rewards points can only be used on Customer Pay repair orders totaling $150.00 or more. Frank Motors reserves the right to determine redemption eligibility.
Membership and Reward Points may not be transferred from account to account. At no time can Members pool accumulated points. Membership and points cannot be sold, bartered, brokered or transferred for any reason except as required by operation of law. Accumulated rewards points may not be redeemed after a change of ownership in the VIP Vehicle.
Earning Reward Points
Reward Points can only be earned on cash purchases at Frank Motors. They cannot be earned on the portion of any purchase made with Reward Points. Qualified purchases include detail services, repairs, maintenance services (excluding body shop repair), parts, and accessories purchased through the service department. You cannot earn Reward Points on new or used vehicle purchases, body shop services, wholesale parts purchases, or services covered by a warranty, insurance or an extended service contract .
Members' account standings can be checked online at www.frankadvantage.com. Transaction credits will be posted within 30 days of the qualified transaction date.
Participation in the Frank Motors Group VIP Advantage Program
The Program is available to customers of Frank Motors who are over the age of 18. Base (Blue) Membership is free to purchasers of new and used cars from Frank Motors on or after January 1, 2011. Gold membership can be purchased in service or base membership can be upgraded to a Gold membership by paying a one-time fee or by completing all the vehicle's first 2 years of factory recommended services at Frank Motors. Only one Rewards card/account may be issued per vehicle.
Employees of Frank Motors, Frank Toyota, Frank Subaru, and Frank Hyundai, and Frank Auto Service are not eligible to participate in the Program.
Corporations, partnerships and other entities (including but not limited to auto body shops, garages, auto repair and maintenance facilities, auto parts wholesalers and retailers, and other similar entities) are not eligible to participate in the Program.
General Terms and Conditions
Members are not eligible to receive other discounts, rewards, or offers in addition or in place of the benefits listed within.
Frank Motors may modify any of the Rules, Terms and Conditions governing the Program, including, but not limited to, the methods through which the Reward Points can be earned, how the Reward Points can be used, the value of the earned points, at any time, without notice, even though these changes may affect the Member's ability to use the points that Member has already earned.
The Program has no pre-determined termination date and may continue until Frank Motors terminates the Program at any time, with or without prior notice. In the event of program termination, all members will have two years from the date of termination to redeem all accumulated points.
Abuse of the Program (including the sale or barter of rewards and any misrepresentation of fact relating thereto or other improper conduct) as determined by Frank Motors in its sole judgment may result in cancellation of Member's account, future disqualification from Program participation, and forfeiture of all points accrued.
Frank Motors and SmartTech Enterprises reserve the right to audit all accounts for compliance with these terms and conditions. In the event an audit reveals discrepancies, the processing of programming earnings may be delayed until such discrepancies are resolved. Frank Motors reserves the right to make any and all decisions as to the validity of accumulated points. All decisions are considered final.
If Frank Motors improperly denies a Member his or her Reward Points, Member's exclusive remedy shall be the issuance of the improperly denied Reward Points. Member shall indemnify and hold harmless Frank Motors and its officers, directors, employees, shareholders, agents and successors or assigns (Frank Motors Parties) from and against any unauthorized access to Member's account by a third party or any other claim arising out of the Program. Under no circumstances, including but not limited to negligence, shall the Frank Motors Parties be liable for any direct, indirect, incidental, special or consequential damages arising out of the Program. By participating in the Program, Member waives any and all rights to bring any claim or action related to such matters in any forum.
